Contact a lawyer. You get what you pay for in such matters is my
experience. Whatever the letter of the law may be this is relatively
new case law and a good attorney could make a huge difference,
especially since the airline likely has much deeper legal pockets than
yourself. You must also weigh how much this is worth to you. To
litigate this case may be very expensive.
