Sadly he is awake and lucid.  If the author of the article or the person 
who originally posted the link to the list were to buy such a device and 
their neighbor complained to the FCC, under part 15 they would be held 
accountable and would have to shutoff or move the device.  This is the 
law.  Will the fcc care... that is a different subject altogether, they 
clearly wouldn't (unless your neighbor was the DOD or some other three 
letter government organization).
