I had thought this passed on a country-wide basis.  Perhaps not the
"Super" version - but as far as I know the DMCA was passed last fall. 
Out local college radio station (http://www.wcsb.org) was off the air
for some time as the RIAA tried to get them to agree to pay a $3000.00
"past transgression" fee and then an additional $500/mo to stream.  I
believe that many similar radio stations have simply given the RIAA/DMCA
the finger and have gone back on the air - I know I got WCSB streaming
again :)
